Welcome to FitForm AI. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

FitForm AI provides AI-powered fitness coaching, workout generation, form analysis, progress tracking, and exercise education services. These terms govern your use of all features, whether free or premium.

2. User Accounts

Account Creation: You must create an account to access FitForm AI services. You agree to provide accurate, current, and complete information during registration.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Age Requirement: You must be at least 13 years old to use FitForm AI. Users under 18 should have parental consent.

3. Subscription and Payment

Free Tier: Basic features including manual workout logging and timer functionality are available at no cost.

Premium Tier: AI-powered features including form analysis, workout generation, progress photo analysis, and AI coaching require a paid subscription.

Billing: Premium subscriptions are billed on a recurring basis (monthly or annually). Your subscription will automatically renew unless cancelled before the renewal date.

Refunds: Refunds are handled on a case-by-case basis in accordance with applicable laws. We generally do not offer refunds for partial subscription periods.

Price Changes: We reserve the right to modify subscription prices with at least 30 days' notice to existing subscribers.

4. AI Services and Limitations

AI-Powered Features: FitForm AI uses artificial intelligence to analyze workout form, generate personalized workouts, track progress through photo analysis, and provide fitness guidance.

Not Professional Medical Advice: Our AI services are for informational and educational purposes only. They do not constitute professional medical, health, or fitness advice. Always consult with qualified healthcare professionals before starting any fitness program.

AI Accuracy: While we strive for accuracy, AI analysis may not always be perfect. You should use your own judgment and, when appropriate, seek professional guidance.

Video and Photo Analysis: By uploading videos and photos for AI analysis, you grant us permission to process these materials for the purpose of providing our services.

5. User Content and Conduct

Your Content: You retain ownership of content you upload (videos, photos, workout logs). By uploading content, you grant FitForm AI a license to process, store, and analyze this content to provide our services.

Prohibited Content: You may not upload content that is illegal, offensive, violent, sexually explicit, or violates others' rights.

Content Removal: We reserve the right to remove content that violates these terms or our Community Guidelines.

6. Health and Safety Disclaimer

Assumption of Risk: Physical exercise involves inherent risks. You acknowledge that participating in fitness activities carries risk of injury.

Medical Clearance: Consult your physician before beginning any exercise program, especially if you have pre-existing health conditions, are pregnant, or are over 35 years old.

Listen to Your Body: Stop exercising immediately if you experience pain, dizziness, shortness of breath, or discomfort.

7. Intellectual Property

FitForm AI Property: All content, features, and functionality of FitForm AI (including but not limited to software, text, graphics, logos, and AI models) are owned by FitForm AI and protected by intellectual property laws.

License to Use: We grant you a limited, non-exclusive, non-transferable license to access and use FitForm AI for personal, non-commercial purposes.

8. Limitation of Liability

To the maximum extent permitted by law, FitForm AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to injuries, loss of profits, data, or other intangible losses.

Our total liability to you for any claims arising from your use of FitForm AI shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Termination

By You: You may cancel your account at any time through the app settings.

By Us: We reserve the right to suspend or terminate your account if you violate these terms or engage in harmful behavior.

10. Changes to Terms

We may modify these Terms of Service at any time. We will notify users of material changes via email or in-app notification. Continued use of FitForm AI after changes constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitForm AI operates, without regard to conflict of law principles.
